Leaked Draft Signals Overturn of Roe V. Wade (The View)
The Supreme Court appears ready to overturn its landmark decisions protecting a pregnant woman’s liberty to choose to have an abortion without excessive government restriction. On May 2nd, 2022, the news outlet Politico published an article that provided an exclusive look at a reported first draft written by Justice Samuel Alito that stated, “Roe was egregiously wrong from the start… We hold that Roe and Casey must be overruled… It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.” If true, the declarations in the draft would be announced by the Court, given that they represented the opinions held by the Court’s conservative majority.
“The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision — Planned Parenthood v. Casey — that largely maintained the right.” Politico writes. Chief Justice John Roberts denounced the leak as a “betrayal” and “a singular and egregious betrayal of trust” that would be fully investigated.
